NY Grassroots Media Conference 2009

Following are the result of the ​You Tube, You Lose: The politics of Internet Video distribution workshop held at the 2009 NYC Grassroots Media conference.

Using the collaborative democracy software, we took as a starting point the most odious of the YouTube terms of service and re-wrote them according to our vision for a progressive, movement-based Internet video service.

• YouTube reserves the right to host your content without judgement as to it's appropriateness and further declines to be a defacto 'enforecer' for claims of copyright advanced by private interest/s regardless their veracity. You agree to filter such content in whatever way you see fit including but not limited to preventing your children from accessing material deemed objectionable.
• YouTube cannot make any changes to the Terms of Service without explicit informed consent of the User Advisory Committee (a diverse body of users representing a broad cross-section of stakeholders that would aim not to be just a self-regulating clique of the usual glad handers and nepotists). YouTube also takes responsibility for openly informing all users of any changes to the Terms of Service via email and posts on the website which should be able to display user comments and feedback
• In connection with User Submissions, you further agree that you will not submit material that is "copyrighted" protected by "trade secret" or otherwise subject to third-party "proprietary rights," including privacy and publicity rights, unless you are the owner of such rights or have permission from their rightful owner to post the material and to grant YouTube all of the license rights granted herein. YouTube will provide all legal costs and offer cookies of suitable quality.
• YouTube does not "in theory" permit "copyright" "infringing activities" and infringement of "intellectual property" rights on its Website, and YouTube will remove all Content and User Submissions if properly notified that such Content or User Submission infringes on another's intellectual property rights.YouTube will contact the user to discuss the reasons for removal or editting the material prior to doing so. YouTube will provide full explanation for their actions.
• For clarity, you retain all of your ownership rights in your User Submissions. However, by submitting User Submissions to YouTube, and pending a Creative Commons license assignment that states otherwise, you hereby grant YouTube a worldwide, non-exclusive, royalty-free license to use, reproduce, distribute and display the User Submissions in connection with the YouTube Website. This agreement will be terminated by the user's removal of the User Submission.
